Our Services

Our professional staff has extensive experience and provide a wide array of services to clients on a fee for service basis and to qualified clients through contracts with the state of New Hampshire.

Guardianship of the Person or of the Estate

Attorneys, social workers, medical providers and those in related fields are occasionally confronted with situations where petitioning for guardianship becomes necessary. In cases where no family member is able to serve as guardian, the Office of Public Guardian may be able to assist by serving as guardian of person or estate or both person and estate.

Guardianship of the Person

  • Ensuring the care, comfort and maintenance of individuals, including housing, food, clothing and other necessities;
  • Arranging for training, education and/or rehabilitation for individuals;
  • Providing informed consent for medical care, counseling and treatment;
  • Maintenance of thorough records regarding each individual;
  • Serves as Social Security Representative Payee and manages all programs of public assistance as well as simple financial management;
  • Guardians are available 24/7 for emergencies via our on call service.

Guardianship of the Estate

  • Managing all real and personal property as well as income and benefits of individuals;
  • Making and filing an inventory of the individual’s estate;
  • Serving as Social Security Representative Payee and managing all programs of public assistance as well as simple financial management;
  • Monitoring to ensure that the individual’s needs can be met within their budget constraints and that expenses are paid to proper payees in a timely manner;
  • Monitoring medical bills to ensure that all medical insurance has been billed before the individual makes any payments.

Trust Administration

OPG serves as professional trustee for trusts created to benefit disabled individuals. Services we provide include:

  • Assistance in preparing and executing necessary legal documents;
  • Working with grantors, beneficiaries and loved ones to protect and maximize the trust assets for the benefit of the beneficiary pursuant to trust terms and public assistance parameters;
  • Maintaining client funds in checking, savings and investment accounts. Where clients have significant assets, OPG partners with TD Wealth;
  • Wealth Management to assist in maximizing clients’ assets through prudent investments.
 

STABLE Account Administration

OPG offers an ABLE (Achieving Better Life Experience) account called “STABLE” for clients who need a way to keep excess resources that would otherwise disqualify them for public benefits like Medicaid or Supplemental Security Income (SSI). Stipulations include:

  • Disability onset prior to age 46 (effective January 2026);
  • Funds in a STABLE account may only be used for “Qualified Disability Expenses,” which includes many necessities;
  • STABLE accounts can also be used to receive disbursements from special needs trusts;
  • STABLE accounts enjoy more flexibility in the use of the funds than are typically associated with trusts;
  • Nominal fees apply with STABLE accounts.

Conservator Services

Conservatorships operate like Estate Guardianships except they are voluntarily entered into by the conservatee. A conservator ensures proper management of the conservatee’s financial affairs, including receiving income, managing assets and ensuring all financial obligations are met.

Representative Payee

The Office of Public Guardian also provides Representative Payee services for individuals under guardianship with OPG. OPG assists with Social Security income, ensuring that funds are used to cover immediate needs and surplus funds are saved for future needs.
